With 10 days to go before a critical appearance in Manhattan criminal court, the attorney for Burress is feverishly working behind the scenes to find a negotiated settlement that would allow Burress to play football in 2009 -- either by reaching a plea deal with minimal jail time or by postponing a possible trial until after the 2009 NFL season with the hopes of playing this fall, a source with knowledge of the case said Friday.

According to ESPN's Sal Paolantonio, attorney Benjamin Brafman has thus far failed to reach a plea agreement on the felony weapons charges against Burress, primarily because the former Giant has been adamant about avoiding jail time, according to sources with knowledge of the case. Any jail time would no doubt be followed up by a visit to NFL commissioner Roger Goodell, who could impose a penalty, including a suspension. NFL spokesman Greg Aiello told Paolantonio on Friday that in the event of a trial postponement, Goodell has not decided what to do. Aiello said Burress, who was released by the Giants on April 3, is a free agent. "A team can sign him," but it's up to the commissioner whether Burress can play, he said. Wow. ... We'll be watching but the notion of Burress avoiding jail time and league discipline seems like a HUGE reach.
