The Facts: Brady's lawyers will file a petition Monday at 3 p.m. for a rehearing of his suspension case against the NFL before the U.S. Second Circuit Court of Appeals in New York. Former U.S. Solicitor General Ted Olson told ABC News in an exclusive interview that Brady's team will petition for a rehearing en banc -- a request for all of the active judges on the second circuit to rehear the case. "The facts here are so drastic, and so apparent, that the court should rehear it," Olson told ABC News in an interview that aired Monday morning.

Monday marks the petition deadline after the court ruled against Brady last month, reinstating the New England Patriots quarterback's four-game suspension for his connection to deflated footballs used in last year's AFC Championship Game. There is no timeline for the court to decide whether or not it will rehear the case. If the court accepts the petition, there would be a stay of Brady's four-game suspension until the new ruling, and he'd be eligible to play. According to NFL Network's Ian Rapoport, if the Second Circuit grants Brady's request, he's essentially guaranteed to play the 2016 season based on timing. If the court chooses not to rehear the case, Brady could then petition the U.S. Supreme Court and ask for a stay of the second circuit decision. It would be a longshot if the Supreme Court heard the case.
